CalCCA Appeals CPUC PCIA Methodology Case to California Supreme Court

After a lower court rejected the California Community Choice Association’s petition to review changes that state regulators made to the Power Charge Indifference Adjustment, the organization has now taken its complaints to the highest court in California. CalCCA initially challenged the California Public Utilities Commission’s revisions of the PCIA calculation process in December in the California Court of Appeal, 3rd District.

In particular, CalCCA says the commission’s changes to resource-adequacy market price benchmarks after utilities had already submitted their Energy Resource Recovery Account forecasts constituted retroactive ratemaking. CalCCA says the methodologies that were in place when the forecast applications were filed in May 2025 should have been the methodologies used during the true-up process that followed.

The utilities file ERRA forecast applications every spring and then file true-up applications in the fall once the new MPB numbers are issued. CalCCA says the commission required the new methodology adopted last summer to not only be used in future cases but also to be applied to the trued-up 2025 rates. Additionally, CalCCA argues that the CPUC did this without proper evidence to support the change in methodology or the use of the new approach in the trued-up rates.
